This website, mobile application is operated by Hands 8 Trading Pte Ltd. Access to the site and/ or the Services (both defined below) is subject to these terms and conditions, our Privacy policy, Cookies policy.
By accessing our site (nayula.com) ordering products from us and/or using the Services, you engage in our “Service” and agree to be legally bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms of Service apply to all Users of the site, including without limitation Users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our site. If you do not agree to all the terms and conditions of this agreement, then you may not access the site or use any services.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our site. It is your responsibility to check this page periodically for changes. Your continued use of or access to the site following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time.You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks included outside of Singapore; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the service or any contact on the website through which the service is provided, without express written permission by us. You may not reproduce, modify, adapt, translate, publish, display, communicate, transmit, broadcast, podcast, webcast, distribute, sell, trade or exploit for any commercial or other purposes, any portion of, or have any access to.
This includes framing, mirroring, linking, spidering, scraping or any other technological means (including any technology available in the future), without the prior written permission of NAYULA.
All NAYULA Content are the copyrighted work of NAYULA or its content or software providers. NAYULA reserves and retains all rights to its Content.

3 - Definitions
In this Agreement, the following definitions shall apply unless the context does not permit it.“NAYULA Content” means all Content of NAYULA that is made available on or via this Site.
“Content” means product listings; product descriptions and reviews; materials; information; news; advertisement; listings; data; input; text; songs; audio; video; picture; graphics; software; blogs; webcasts; podcasts; broadcasts; messages; software; comments; suggestions; ideas; and other content.
“Marks” means the logo, trademarks and service marks used on the Site.
“Products” means NAYULA products ordered and/or services provided on this Site.
“Computer” means your computer; notebook computer; personal digital assistant; mobile phone; tablet device; or other electronic device used to access this Site or the Services.

* Any other features, content or applications that NAYULA may offer on the Site from time to time in its sole and absolute discretion.
* You acknowledge and agree that by placing an order for products and to access and use certain Services, you will agree to these terms and conditions, our Privacy policy, Cookies policy
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
6 – Products or services (if applicable)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear. We cannot guarantee that your computer monitor's display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
7- Account information
By providing the information requested for your Account, you consent to NAYULA’s use and disclosure of all such information for the purposes set out in our Privacy Policy.You agree that NAYULA has the right in its sole and absolute discretion and without notice.
Restrict, suspend, or terminate your access to all or any part of the Site or Services; and/or terminate, deactivate or suspend your Account, delete your Account and all related information and files in your Account, without assigning any reason.
Without prejudice to the generality of the above, NAYULA reserves the right to deactivate your Account if it has been inactive for a period of six (6) months or more, or if you are in breach of any terms in this Agreement or if NAYULA believes you have been using the Account for unlawful and/or undesirable activities.
We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You agree not to hold NAYULA liable or responsible for any loss or damage incurred by you arising out of, or in connection with the suspension and/or termination of your Account.
Password and Account
NAYULA may require you to register an online account ("Account") to enable you to access and use certain parts of this site or access certain services. You agree that your Account is for your sole, personal use.- You agree not to assign or otherwise transfer your Account to any other person or entity
- You will be responsible for, and NAYULA shall be entitled to rely on, all communications transmitted through the use of your User ID and Password, and all such communications shall be deemed to be communications made and issued by you.
- You may not select or use a user ID of another person with the intent to impersonate that person.
- You may not use a user ID that NAYULA, in its sole discretion, deems inappropriate or offensive.
- You shall promptly notify NAYULA of any known or suspected unauthorized use(s) of your Account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password. You will be responsible for safeguarding and maintaining the confidentiality of your user ID and password.
- NAYULA shall have no responsibility or liability for any loss, damage, cost, expenses, or liabilities arising as a result of or in connection with the wrongful or fraudulent use of your user ID and password.
- You will be responsible for all user content, messages, and all online activity at the site transmitted or conducted through the use of your user ID and password.
8 – Optional tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

If, at our request, or without a request from us you send suggestions, proposals, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. - Grant NAYULA and its subcontractors (including its Internet content hosting servers and delivery networks) a non-exclusive, royalty-free, irrevocable, perpetual and worldwide licence to use (including without limitation, to store, reproduce, modify, distribute, publish, display, communicate, transmit, broadcast, podcast, webcast, or broadcast) and to sub-licence the User Content whether or not in connection with the provision of the Services and/or on or via the Site, other websites, in-store displays and other printed and online publications.
- Represent and warrant that none of the User Content are Improper Works, nor will they expose NAYULA to any civil or criminal proceedings in any part of the world.
- NAYULA at all times retains the sole discretion to remove or decline to accept any User Content from the Site without assigning any reason whatsoever. Without limiting the foregoing right, NAYULA may monitor the Site for Improper Works (but is not obliged to do so) and reserves the right to remove any User Content which NAYULA believes are Improper Works, or which is the subject of any dispute.
- You agree to indemnify and hold NAYULA and its officers, agents, co-branders or other partners, and employees, harmless from all claims, demands, actions, proceedings, liabilities (including statutory liability and liability to third parties), penalties, and costs (including without limitation, legal costs on a full indemnity basis), awards, losses and/or expenses, due to or arising out of any User Content or Improper Works you submit, post to or transmit through the Site or Services.

Without limiting the foregoing, NAYULA does not warrant that the functions contained in or access to the Site, Services, NAYULA Content or other content will be timely, uninterrupted or error-free or without omission, that defects will be corrected, or that the Site, Services, NAYULA Content or the Servers are free of viruses or other harmful components, or that the download, installation or use of any NAYULA Content in or with any Computer will not affect the functionality or performance of the Computer.
You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Hands 8 Trading Pte Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Hands 8 Trading Pte Ltd, affiliates, partners, officers, directors, agents, licensors, service providers, suppliers, interns, and employees, harmless from any claim or demand, liabilities (including statutory liability and liability to third parties), penalties, and costs (including without limitation, legal costs on a full indemnity basis), awards, losses and/or expenses including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.15 - Severability

The name of NAYULA or any other Marks may not be used in any way, including in any advertising or publicity, or as a hyperlink without prior written permission from NAYULA.The domain name on which the Site is hosted on is the sole property of NAYULA and you may not use, or otherwise adopt a similar name for your own use.
20– Governing law and Jurisdiction
These Web Terms and all matters relating to your access to, or use of, this Site and the Services shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. You hereby agree to submit to the exclusive jurisdiction of the Singapore courts.

Should there be any inconsistency between the English language version of this Terms of Use and any translation hereof, the English language version shall prevail.

Online shopping Guide
Terms of sale
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made
Payment:
We accept payment via MasterCard, Visa, American Express, Shop pay, Apple pay and Google pay under Shopify system.
NAYULA does not store any customer's credit/debit card information. When you pay by credit/debit card, all credit/debit card information is directly transacted in shopify payment to CyberSource or our payment gateway providers.
3-D Secure is an XML-based protocol used as an added layer of security for online credit and debit card transactions. It was developed by Visa to improve the security of internet payments and offered to customers as the Verified Visa service. Services based on the protocol have also been adopted by MasterCard, under the name MasterCard Secure Code. 3-D Secure adds another authentication step for online payments. 3-D Secure should not be confused with the Card Security Code (commonly known as CVV) which is a short numeric code that is printed at the back of the credit card.
CyberSource, a wholly owned subsidiary of Visa Inc., is the only integrated payment management platform built on secure Visa infrastructure and is one of the leading providers for internet and mobile payment services. CyberSource provides its services to banks, corporations and e-businesses in the worldwide market. For credit card payments, you will be linked to CyberSource’s website, a secure site where all your credit card information will be stored.
All payments made via debit cards will have two records, authorisation and settlement. Authorisation refers to funds held by the bank, and settlement refers to the process where the merchant has captured the fund that was on hold previously. Please note that you are only charged once although there are two separate records of authorisation and settlement. Please check with your bank for further clarification.
All payments made using a debit card will result in two records: authorisation and settlement. You will see both records reflected on your online bank statement. Authorisation refers to funds held by the bank while the payment is in the process of being approved or declined. Settlement refers to the actual payment (i.e the merchant has captured the fund that was on hold previously). Please note that although there are two records, there is only one single charge. For further clarification, please speak to your bank.
The order is confirmed to be final once payment has been made.
You can only cancel your order before we make the delivery arrangement. To cancel the order placed, please email to customer@nayula.com within 24hours after the order is placed. The refund will minus 5% processing fees.
After you have placed an order with us, we will send you an email an acknowledgment of that order to your designated email address.
This acknowledgment is a confirmation and receipt of your order.
